By accessing or using Indie-Builds.com ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all visitors, users, and anyone who accesses or uses the Platform.
2. Description of Service
Indie-Builds.com is a community-driven platform where indie makers can submit, discover, and upvote independent apps, websites, SaaS tools, AI tools, and games. The Platform allows registered users to:
- Submit their own indie projects for community discovery.
- Browse and upvote projects submitted by others.
- View maker profiles and leaderboards.
- Purchase advertising slots to promote their projects.
3. User Accounts
To submit projects or upvote, you must create an account. You agree to:
- Provide accurate, complete, and current account information.
- Maintain the security of your account credentials.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activities that occur under your account.
We reserve the right to terminate accounts that violate these Terms or are used for fraudulent or abusive purposes.
4. Submitted Content
By submitting content to the Platform (including project descriptions, logos, screenshots, and URLs), you represent and warrant that:
- You own or have the necessary rights to the submitted content.
- The content does not infringe any third-party intellectual property rights.
- The content is accurate, legitimate, and not misleading.
- The content does not violate any applicable laws or regulations.
You grant Indie-Builds.com a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your submitted content on the Platform.
5. Prohibited Conduct
You agree not to:
- Submit false, deceptive, or fraudulent project information.
- Use automated bots or scripts to artificially inflate upvotes.
- Submit spam, malware links, or malicious content.
- Harass, threaten, or abuse other users.
- Attempt to gain unauthorized access to the Platform or its systems.
- Scrape or harvest data from the Platform without express permission.
- Impersonate another person or entity.
- Submit content that is illegal, obscene, or violates third-party rights.
6. Advertising & Payments
Advertising slots on the Platform are available for purchase. By purchasing an advertisement:
- You agree to the pricing and duration displayed at the time of purchase.
- All payments are processed securely through Dodo Payments. We do not store your payment card details.
- Advertising content must comply with our content guidelines and must not be deceptive, illegal, or harmful.
- We reserve the right to reject or remove advertisements at our discretion.
- Refunds are handled on a case-by-case basis. Contact bigzapps@gmail.com for refund requests.
7. Intellectual Property
The Platform, its design, logo, features, and content created by Indie-Builds.com are owned by us and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
User-submitted content remains the property of the respective submitters. We claim no ownership over content you submit, beyond the license granted in Section 4.
8. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The Platform will be uninterrupted, error-free, or secure.
- The content submitted by users is accurate, complete, or reliable.
- Any defects or errors will be corrected.
We are not responsible for the quality, safety, or legality of projects listed on the Platform.
9. Limitation of Liability
To the fullest extent permitted by law, Indie-Builds.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, goodwill, or other intangible losses.
10. Third-Party Links
The Platform contains links to external websites and projects submitted by users. We do not endorse or assume responsibility for any third-party content, websites, products, or services. Accessing third-party links is at your own risk.
11. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, the Platform, or third parties.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or the courts of the applicable jurisdiction.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will post the updated Terms on this page with a new "Last updated" date. Your continued use of the Platform after changes constitutes your acceptance of the revised Terms.
